GENERAL CONDITIONS OF USE OF THE PORTAL: www.talentosdesign.com


The Fundación Banco Santander (hereinafter referred to as the Foundation) with legal address at C/ Serrano nº 92, Madrid, registered in the Registry of Foundations of the Ministry of Justice under number 321 and with contact e-mail address: fundacionbs@gruposantander.com in cooperation with the Portal Universia S.A. (hereinafter, Universia) domiciled at Avenida Cantabria s/n, Boadilla del Monte, Madrid, Spain, with CIF A-82726639, registered in the Trade Registry of Madrid, in Volume 15,717; Book 0, Page 1, Section 8, sheet M-264916, Entry 1, and contact e-mail at: registro@universia.net, offers Internet users the free Portal: www.talentosdesign.com (hereinafter, the PORTAL) to enable them to register as participants, if eligible, in the “TalentosDesign '12 Contest” (hereinafter the CONTEST), visit and/or vote on projects submitted to THE PORTAL’s contest. This contest is organized by the Foundation to encourage, recognize, publicize and reward creativity in art and sustainable design, among the university community.

1. - Purpose and Modification of conditions
The Foundation provides USERS the opportunity to register as participants in the CONTEST through the PORTAL or just visit it and/or vote on projects submitted to the contest, provided they do so in accordance with the provisions of these GENERAL CONDITIONS. In any case, the Foundation reserves the right at any time without prior notice, to modify or delete the content, structure, layout, services and conditions of access and/or use of this site, whenever it deems appropriate.

2. - Requisites for accessing and using the PORTAL
To enrol in the CONTEST through the PORTAL, it is required to be registered as a USER on any portal of the Universia network. If you are not registered, you can do so at the same time you enter the Contest, thus becoming a USER of Universia Spain (www.universia.es).

In their collaboration, UNIVERSIA is responsible for processing the registration of users, on behalf of the Foundation, and the Foundation shall have access to participants’ data after completion of registration.

Access and/or use of the PORTAL are completely voluntary and grant to whoever does so the condition of USER. All USERS, registered or not as a participant in the PORTAL, accept, from the very moment when accessed, without any reservations, the content of these “General Conditions”. Consequently, the USER must read these conditions carefully before accessing.

3. - General Principles – User Responsibility

The USER undertakes to use the service provided by the PORTAL in accordance with current legislation, following the principles of good faith and generally accepted practices and not to contravene with their actions, through the PORTAL, public order or the provisions of these Terms. Therefore, any use for unlawful purpose or that damages or impedes the use of, or that may damage and/or overload in any form, normal use and operation of the PORTAL, or directly or indirectly attacks it or any third party is expressly prohibited.

PORTAL USERS agree to provide true and accurate information about themselves in the CONTEST registration form.

Conditions to be met by users who want to establish a link between their website and the PORTAL

No reproduction is allowed of PORTAL pages by hyperlink from another site or web page, allowing access only to them.

In no case will it be understood that the Foundation authorized the Hyperlink or has supervised or assumed in any way the services or content offered by the site from which the hyperlink occurs.

No false statements or false, incorrect or inaccurate references can be made on the Foundation’s pages or services.

The page from where the hyperlink is established can have no distinctive feature referring to the PORTAL, except the signs integrated in the hyperlink itself.

The creation of any type of browser or border environment on the PORTAL is explicitly prohibited.

Content contrary to the rights of others, or contrary to morals and generally accepted good conduct or illegal content or information cannot be included on the web page from which the hyperlink is established.

The existence of a hyperlink between a website and the PORTAL does not imply the existence of a relationship between the Foundation and the owner of that page or the acceptance and approval of its content and services.

5. - USER responsibility

The USER is solely responsible for the use of the PORTAL and full compliance with these GENERAL CONDITIONS. Consequently, the USER agrees to keep secret the nature of confidential and proprietary information, access codes, passwords or similar data assigned to access the PORTAL and its services, and is responsible for any damages of any nature arising from misuse by themselves or by third parties, both against the user themselves, considering the damage suffered as a result of negligence, as the well as any the Foundation may suffer as a result of breach of these TERMS AND CONDITIONS.

Any violation of these GENERAL CONDITIONS may result in court proceedings or civil or criminal court against the user, who must hold the Foundation harmless against any claims, suits or damages it may suffer as a result of such violation.

6. - Exclusion of Warranties and Liability

The Foundation does not accept responsibility, in any case or circumstance, for the following facts and content, or for any damages that may, where appropriate, arise from:

Lack of availability, continuity, access, maintenance and effective functioning of the PORTAL and/or its services and update, accuracy, completeness, relevance, timeliness and reliability of its contents, whatever the cause and the difficulties or technical or other problems in which these events have their origin.

The transmission and/or existence of viruses, other harmful elements or programs for users’ computers that may affect them as a result of access, use or examination of the site, or produce changes in their electronic documents or files.

Illicit, negligent or fraudulent use, impersonating another person or contrary to the content of these general conditions, good faith, generally accepted uses or public order, of the PORTAL and its services by USERS.

Except for those signs that form part of the hyperlink, the web page on which the hyperlink is established must not contain any trademark, trade name, establishment sign, name, logo, slogan or other distinctive signs belonging to the Foundation.

Of violations or breaches of the laws, usages or customs in regard to intellectual property rights, industrial property, trade or contractual secrets, rights of privacy, honour, image, property, advertising and competition, among others, by third parties,
defectiveness of the content and/or services that are accessed through the PORTAL,
for the reception, storage, collection, distribution or transmission by USERS of PORTAL content. For the knowledge of any information they may possess or used by unauthorized third parties of the characteristics and circumstances of use of the content and services of the PORTAL by USERS.

Due to the failure, by third parties, of their obligations or guarantees under or incurred in connection with the services provided to USERS through the PORTAL, as well as the lack of quality, reliability, suitability to that offered, legality, usefulness and availability of services provided by third parties and made available to USERS at these sites.

The above list merely includes but is not limited to or, in any case, exclusive of or exclusionary in any of its points. In all cases, THE FOUNDATION EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE ARISING DIRECTLY OR INDIRECTLY FROM ANY OF THEM AND OTHER SIMILAR UNSPECIFIED ANALOGOUS FEATURES.

7. - Links
The PORTAL includes within its content links to sites owned and/or managed by third parties in order to facilitate access to information and services available through the Internet.

The Foundation assumes no responsibility arising from the existence of links among the content of the PORTAL and content outside of it or any other mention of content external to this site. Said links or references are for informational purposes only and, in no case, imply support, endorsement, marketing or any relationship between Universia and the people or creator or administrator entities of such contents or sites where they are found.

In this sense, the USER agrees to put the utmost care and prudence in the case of access or use of the content or services of the sites accessed by virtue of such links.

8. Use of cookies
The website of the PORTAL sometimes uses small data files called “cookies” that are generated in the USER’S computer and provide the following information:

Cookies generally have a limited life time. No cookie allows the Foundation, UNIVERSIA or other Users to obtain the USER'S phone number, email address or other personal contact information, except for the data provided by the USER. No cookie can extract information from the USER'S hard drive or enable theft of personal information. The only way that the private information of a USER is part of the cookie is that the user personally gave this information to the server.

The USER has the option of preventing the creation of cookies by selecting the appropriate option in their browser, although disabling them may prevent, in some cases, proper functioning of the page.


9. - Intellectual and Industrial Property Rights
The text, graphics, images, databases, logos, structure, trademarks and other elements of this site are protected by laws and international treaties on intellectual and industrial property. Any reproduction, transmission, adaptation, translation, modification, public communication or any other use of all or part of the contents of this site, made ​​in any form or by any means, electronic, mechanical or otherwise, is strictly prohibited without prior written authorization from Universia. Any infringement of these rights can lead to extrajudicial procedures or civil or criminal court as appropriate.
The Foundation does not grant any license or authorization of use of any kind on its intellectual or industrial property, or any other property or right related to the PORTAL, services or contents.
The legitimacy of the intellectual property rights for the contents provided by third parties is their sole responsibility.
In order to preserve possible intellectual property rights, in the event that any USER or third party considers that there has been a violation of their legitimate rights by the introduction of a specific content on the PORTAL, you must notify this circumstance, in writing to FUNDACIÓN BANCO SANTANDER CENTRAL HISPANO, Calle Serrano 92, 28006, Madrid, Spain Tel: +34 917815158, Fax: +34 917815159 stating:
Personal data identifying the holder of the rights allegedly infringed. If the claim is submitted by someone other than the person concerned, the person presenting the claim must indicate on whose behalf he or she is acting.
Indication of the material protected by intellectual property rights and their location on the PORTAL.
Proof of the existence, ownership and validity of such intellectual property rights.
Express statement in which the interested party claims responsibility for the accuracy of the data and information provided in the notification referred to this point.


10. - Applicable law and Jurisdiction
These general conditions are governed by Spanish law.
For any questions which may arise or actions arising from the provision by the Foundation and the services and content of the PORTAL and on the interpretation, application, enforcement or breach of what is established, the Foundation and the USER expressly waive any other jurisdiction that may apply, and become subject to the jurisdiction of the Courts and Tribunals of Madrid.
