TalentosDesign'12, Sustainable Design

The FUNDACIÓN BANCO SANTANDER, with CIF G 80576200 and registered office in Calle Serrano 92, Madrid, 28006, announces the fourth edition of TalentosDesign, a design competition for university and higher education students, in order to encourage, recognize, publicize and reward creativity and talent within the context of design among this group.

The contest is governed by the following rules:


1. Participants
Students can participate who are of legal age (18 years), from any university or school of higher education, regardless of their nationality, from any country in the world. It is essential that participants are enrolled in the 2011/2012 academic year.

In any case, employees of the Fundación Banco Santander are excluded from participation in this contest.


2. Subject
Five thematic categories are defined to which the works or projects can be submitted to the contest; they are:

3. Requisites for participation


a. Admission of works
To participate, contestants must be users of Universia or register with the web http://talentosdesign.fundacionbancosantander.com. The works must be uploaded to the web in digital format: .jpg - maximum weight of 1MB per piece) or in video format (.avi; .mov;. mpeg or .wmv that can weigh up to 10 MB, or an Internet address where you have stored the project, depending on the category you want to participate in, in accordance with the provisions of Section 3. b) Technical Requirements. Moreover, it will also be required to complete an informational sheet that summarizes and explains the project submitted to the contest.
Projects must be original or be produced. In any case, participants must be the legal owner of the intellectual property rights of the works necessary to comply with the provisions of these Rules. In the event the work is owned by several people, the participant who submits it must be one of its co-authors, and must have authorization from the other co-authors to make the submission, the acceptance of these conditions and to collect the prize on behalf of all, should the project win.
The organization reserves the right to require participants to prove their ownership of the project presented and, in the event of any co-authors, the authorization given by them for the submission of the work in the competition on the terms set out in the section above.
In the event one of his or her works is selected as a winner, the participant must provide the Organization with the necessary materials for its possible exhibition, and it shall be the Organization that decides how to present each of the projects in accordance with the provisions in the section below: b) Technical Requirements. If the participant fails to comply with this requirement, the organization may reject the work. All costs of the exhibition of the projects shall be borne by the Organization.
Each contestant may submit up to two works per category, i.e., a total of 10 works and, within each category, will have complete freedom in regard to aesthetic tendency.
The Organization reserves the right to reject or exclude from the contest projects presented in the following cases:

For users to be able to upload to the contest webpage works they wish to have participate in it, they must meet, depending on the category of participation, the following technical requirements:

Likewise, contestants must keep in mind that the works submitted must have the necessary materials, size, format and quality to be exhibited. To this end, the contestants whose works are selected in the first phase, must send the Organization (on a CD or other media), all the materials needed and required by the Organization for works can be displayed, which will assess each case independently, and must meet, in any case, the following technical requirements:

The Organization, in any case, may reject a project if it considers that it does not meet the requirements of the Organization or does not meet the technical requirements or minimum quality for exhibition.
The Organization reserves the right to exhibit, or not, the projects selected in the manner it deems most appropriate.


4. Selection of works
The projects presented by the contestants will be visible on the contest website http://talentosdesign.fundacionbancosantander.com
The Internet audience can vote on all projects in a contest and a maximum of 50 projects will be selected.
Selected by the internet public shall be understood as those projects that achieve the highest average score and - in case of a tie - the Organization will decide. For this purpose, average score shall be understood as the figure obtained by dividing the total score for each project between the numbers of times it has been scored. The Organization reserves the right to require a minimum number of votes to select a project.
Both the organization and the costs of the exhibition of selected projects will be borne by the Organization.
Of all the projects selected by Internet voters, a jury selected by the Foundation will select a total of 6 works, 1 of which will be the winner and the other 5 will be runner-ups. The jury also may declare void at any time any of the prizes.
Once the jury has selected the winner and the runner-ups, they will be informed via the phone number provided during registration, as well as by email. At this time, the Foundation will inform the winners of the place, date and time the award will be presented.
In the event the winner of the contest or any of the runners-up has not been located within 5 calendar days of the jury’s decision, they will decide whether to declare the award void or select a new work, or reallocate the prize awarded. The jury may, at any time, declare any of the prizes void.


5. - Timetable
Contestants may submit their work from 11:00 a.m. (Spanish time) from February 1, 2012. The deadline for acceptance of entries is May 10, 2012 at 17:00 p.m. (Spanish time).
The voting period will start at 11:00 a.m. (Spanish time) on February 1, 2012 and end on May 17, 2012, at 17:00 (Spanish time).
The notification of the works selected for exhibition will take place on June 12, 2012. Such notice shall be given by telephone or e-mail address provided by participants to register for the contest.
Participants whose projects have been selected must submit all materials required by the Organization and on the terms set out in the section covering the submission of works and technical requirements, to the address provided to them at that time.
The Organization shall give notification through the contest website: http://talentosdesign.fundacionbancosantander.com of the date, place and duration of exhibition of the selected projects.
Notification of the winning project and runners-up will be made on June 28, 2012 and the awards ceremony will take place in autumn 2012, at the inauguration of the exhibition.


6. Awards
The winner will receive a prize of 5,000 euros net plus exhibition of the winning entry. There will also be 5 runners-up who will be awarded €2,500 net each. Legally due taxes must be paid on the amounts of the prize and that of the runners-up.


7. Intellectual property rights
The rights of use, dissemination, distribution, exhibition, public communication, transmission and reproduction of selected projects in each category of the winning project and 5 runners-up will be transferred to the Fundación Banco Santander.
Likewise, rights shall be transferred to the Foundation to broadcast, distribute, communicate publicly or reproduce the other projects submitted to the contest necessary so the Foundation can reproduce and communicate publically, free of charge, and identify their authors, if the Foundation deems it necessary, through the current or future portals of the Universia network.
The purpose of these transfers of rights is to ensure the Foundation has the necessary legal rights to publish and reproduce the projects selected in the contest for informational and informative purposes, while it is being carried out and after its completion. The Foundation ensures that, in no case, will it disclose or publish the selected projects for profit or purposes detrimental to the authors, given that the Foundation is a non-profit entity with the purpose of developing cultural, humanistic and scientific activities of general interest.

8. - Protection of personal information
Participants in this contest accept and consent that personal data required for entry to the contest are included in a computerised file owned by Fundación Banco Santander and processed in order to carry out the competition in accordance with Organic Law 15/1999 on the Protection of Personal Information. Submission of the personal data required for entering the competition is mandatory to carry it out.
Similarly, the Fundación Banco Santander has adopted safety standards for protection of personal information required and installs other such means and technical measures within its power to prevent the loss, misuse, alteration, unauthorized access and theft of Personal Information supplied by the contestants.
The participating user guarantees that the personal information provided to the Fundación Banco Santander in connection with this promotion are truthful and is responsible for notifying the Foundation of any changes in them.
The Foundation is expressly authorized to use such data for purposes of communication and advertising of its activities. The contestants expressly authorize the Foundation to send notifications of its promotions and activities, including electronic notifications in the terms set forth in art. 21 of Law 34/2002, on information society services. This authorization is directly related to the creation and maintenance of the contractual relationship with the user stemming from the fact of having registered for the contest, since it is a necessary condition to participating in it.
Participants also authorize the Foundation to use their name and likeness in advertising or notifications, either written or electronic, which the Foundation uses to develop or carry out and disseminate the results of the contest.
Contestants have and may exercise their rights of access, cancellation, rectification and opposition by contacting in writing the Fundación Banco Santander at the following address: Calle Serrano 92, Madrid, CP 28006.


9. - Complaints, legislation and applicable jurisdiction.
Any complaint about the initial selection of 50 projects or the jury’s choice of award, winning projects or runners-up must be made within a maximum period of 10 days from the date of notification provided. All other claims must also be made within 10 days from the fact motivating them.
This contest and its rules are governed by Spanish law and any dispute related thereto or to the contest shall be resolved by the courts of Madrid.


10. - Tacit acceptance of the rules
Mere participation in this contest implies complete acceptance of all these terms.
The Fundación Banco Santander reserves the right to interpret or modify the conditions of this contest at any time, and even to cancel or rescind it, provided that there is valid reason. In any event, the Foundation shall undertake to communicate in the same manner the rule changes, or, if applicable, the cancellation of the contest as a whole, so that all participants have access to such information.

The rules shall be deposited with the Notary Public in Boadilla del Monte, Mr Gonzalo Sauca Polanco and will be posted on the website available to any person wishing to consult them and in the electronic file of contest rules (ABACO), a service of general interest provided by the General Council of Notaries, which can be accessed through its Web: www.notariado.org/ABACO.
